1. Guard Select’s role
Guard Select is operated by Guard Select Limited, a licensed New Zealand security company (Private Security Personnel Licensing Authority licence No. 26-141664, held in all licence classes). When a client books security services through the platform, the client contracts with Guard Select Limited as the provider of those security services. Guard Select delivers the services through vetted independent contractor guards who hold a current Certificate of Approval, verified before any job offer is sent. The platform is how Guard Select manages bookings, compliance verification, shift records, communications, and payments.
2. Guard working arrangements
Guards are engaged by Guard Select Limited as independent contractors and are not employees of Guard Select. Guards operate their own business, set their own availability, and choose which offers they accept or decline. Because payments to guards are schedular payments under New Zealand labour-hire rules, Guard Select deducts withholding tax from guard payments as required by law — at the guard’s valid elected rate, at 0% only under an approved special tax rate certificate, or at the no-notification rate where no valid election or certificate is on file — and remits it to Inland Revenue. The full terms of each guard’s engagement are set out in the Guard Select contractor agreement. Guards remain responsible for their own wider tax affairs and should seek independent legal or tax advice where required.
3. New Zealand legal compliance
All users are responsible for complying with applicable New Zealand laws, regulations, licensing rules, tax obligations, employment obligations, health and safety duties, privacy obligations, and any site-specific requirements that apply to their use of Guard Select or any security work arranged through the platform.
4. Security licensing and PSPLA requirements
Security work must comply with the Private Security Personnel and Private Investigators Act 2010 and any requirements of the Private Security Personnel Licensing Authority (PSPLA). Guards must hold the correct current Certificate of Approval (COA) or other required licence for the work they accept. Clients and licensed security companies must not request or permit unlawful or unlicensed security work.
5. Privacy and information handling
Users must handle personal information responsibly and in accordance with the New Zealand Privacy Act 2020 where applicable. Users must not upload, share, or misuse another person’s personal information unless they have a lawful reason to do so. Guard Select uses information submitted through the platform to operate accounts, bookings, compliance checks, payments, notifications, and support processes.
6. Eligibility and accurate information
Guards must be legally eligible to work in New Zealand, provide accurate profile and compliance information, and keep qualifications, contact details, banking details, and availability up to date. Clients must be legally authorised to request security services and must provide accurate site, risk, contact, and booking information.
7. Payments, subscriptions, cancellation, and refunds
Security services are paid for at the time of booking unless Guard Select Limited has expressly agreed different payment terms with a client in writing; Guard Select does not extend credit terms by default. Platform subscriptions, booking payments, service fees, GST, and any cancellation or refund handling are displayed in the app where applicable and may be processed securely through Stripe. Amounts payable for security services include GST where applicable. Guard and client subscription prices are shown before checkout. Users may manage or cancel subscriptions through the in-app subscription/account area where supported. Cancellation stops future subscription billing according to the applicable billing period; it does not automatically refund previous periods, completed bookings, or platform fees unless required by law or approved by Guard Select. Refunds, chargebacks, failed payments, disputes, and payment holds may be reviewed by Guard Select and Stripe. Nothing in these terms limits consumer rights under the New Zealand Consumer Guarantees Act 1993 where it applies.
8. Booking, completion, and platform fees
Bookings must be created and completed honestly through the platform. Clients pay Guard Select Limited for security services; Guard Select then pays each guard their contracted amount after deducting any platform fee and any withholding tax required by law, as shown in the app. When a client confirms a completed shift, Guard Select calculates the applicable fees, GST, billable hours, and payout information shown in the app. Users must not bypass platform payment processes, submit false hours, or misrepresent shift completion.
9. Health and safety responsibilities
Clients and site controllers must disclose known hazards, site risks, emergency procedures, access requirements, and any special instructions relevant to the work. Guards must take reasonable care for their own health and safety and the health and safety of others, follow lawful site instructions, and decline or report unsafe work where appropriate. Guard Select may restrict platform access where safety concerns are raised, but it does not control every worksite.
10. Dispute resolution
Disputes about bookings, payments, conduct, or shift completion are resolved under the Guard Select Dispute Resolution Policy (guardselect.co.nz/dispute-policy), which forms part of these terms. In summary: payment for an attended shift is released automatically unless the guard was a direct no-show; every dispute is decided on its own evidence; and disputes escalate through platform review, a three-way video call, and independent resolution. Users remain free to seek independent legal advice or use any dispute process available under New Zealand law, including the Disputes Tribunal.
11. Prohibited conduct
Users must not misrepresent qualifications or documents, perform or request unlicensed security work, harass or threaten another person, upload false information, use the platform for unlawful activity, interfere with platform systems, or attempt to avoid platform payment, subscription, compliance, or safety controls.
12. Limitation of liability
Guard Select Limited provides its services with reasonable care and skill. To the extent permitted by New Zealand law, Guard Select Limited is not liable for indirect or consequential loss, loss of profit, or loss of opportunity, and is not responsible for loss caused by inaccurate information supplied by a user, unlawful conduct of a user, or the acts of external payment providers. Where liability cannot lawfully be excluded, liability is limited to the maximum extent and amount permitted by law. This section does not limit rights or remedies that cannot legally be excluded, including rights under the Consumer Guarantees Act 1993 where applicable.
13. Changes to these terms
Guard Select may update these terms from time to time. Users will be notified of material changes where appropriate. Continued use of the platform after an update means the user accepts the updated terms.
14. Governing law
These terms are governed by the laws of New Zealand. Any dispute relating to these terms or use of Guard Select is subject to New Zealand law and, where court proceedings are required, the jurisdiction of New Zealand courts.
